By purchasing via this website you agree to be bound by the terms and conditions as laid out below.
These terms and conditions apply to online transactions only and do not apply to any purchases made in a Homewood Interiors store.

These terms and conditions do not affect your statutory rights as a consumer.

Definitions:
1) “Buyer” means the person who agrees to buy goods from Right Price Furniture Ltd.
2) “Goods” means all products listed on the order form
3) “Seller” means Right Price Furniture Ltd.
4) “Consumer” shall bear the meaning ascribed in section 12 Unfair Contract Terms Act 1977.
5) “Delivery” means delivery of the goods to the most easily accessible ground floor external door of the delivery address specified on the order unless otherwise expressly agreed in writing.

Limitations of Liability;
1) The Seller shall not be liable for any direct or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance /or non performance of this contract.
2) The Seller’s total liability in regard to the performance of this contract shall be limited to the value of the Goods.
3) English law shall govern all contracts.
5) Once the Seller has received the Buyer’s order and determined the availability of stock the Seller will contact the Buyer to arrange for payment and  the Delivery of the Goods. Acceptance of the Buyer’s order and the creation of a legally binding contract between the Seller and the Buyer will only occur when the Seller sends the Buyer a second e-mail which contains confirmation of the Buyer’s payment and details of the Delivery..
6) The Seller retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer not more than the sum which has been paid already by the Buyer to the Seller in relation to the refused order.

Risk and Ownership;
1) The Buyer shall take full responsibility for the Goods once Delivery has taken place. The Buyer must take all reasonable care of the Goods. Should the Goods be returned to the Seller having been damaged while in the Buyer’s care, the cost of such damage will be recovered from the Buyer forthwith and as a debt. Any payment outstanding after 14 days shall accrue interest at the rate of 4% above the base interest rate charge by Natwest Bank
2) Ownership of the Goods will only pass when cleared funds have been received by the Seller from the Buyer and when Delivery has taken place.

Description of the Goods;
1) The description of the Goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order.
2) All dimensions given are approximate and the Buyer should satisfy itself that the Goods can be delivered at the time of Delivery. The Buyer will incur a fixed charge of �65.00 for any Goods which need to be returned to the Seller. The Buyer will in addition be responsible for any postage/courier charges for Goods not delivered in person.

Payment;
1) Full payment is required at the time the order is accepted and the Seller will collect payment from debit/credit card details as supplied by the Buyer.
2) All prices and charges on this site are in UK sterling and inclusive of  Value Added Tax at the current rate.

Delivery;
1)    Delivery will normally take place within the timescales estimated within the order acknowledgement sent following acceptance of the order by the Seller however this is only an estimate and time shall not be the essence of any order.
2) Where the Goods cannot be delivered on the day arranged due to the fault of the Buyer, the Seller retains the right to charge for “re-delivery” to cover costs incurred.
3) In the event Delivery exceeds the estimated delivery date the Buyer can request a full refund of the cost of the Goods and the Seller will provide a full refund forthwith on the basis that the Seller incurs no charge in so doing. The Buyer authorises the Seller to deduct the full price and any subsequent delivery charge from the Buyer 7 days before Delivery actually occurs.      
4) Goods will be taken to the room of choice at the driver’s discretion if access is clear and agreed by the Seller in writing in advance of Delivery.   The Seller shall not be liable for any damage caused to the delivery address by reason of the Delivery.
5) Most goods may require some sort of assembly and it is the Buyer’s responsibility to assemble the goods.
6) Delivery will only be made to the delivery address specified within the Seller’s acknowledgement of the original order.
7) Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address.

Guarantees;
1) All Goods are guaranteed against faulty materials and workmanship for a minimum period of six months from the date of the Delivery subject to:-
a.  the claim being notified to the Seller in writing within 7 days of the date of discovery and in any event within 6 months of Delivery;
b. the recommendations for installation, maintenance and use have been complied with;
2) Any guarantees provided by the Seller shall not include any liability in respect of:-
a. Damage caused by inappropriate use;
b. Soiling, pet damage or other damage caused by third parties;
c. Natural changes in colour or dimensions of natural products being part of the Goods.

Faulty Goods;
1) Complaints relating to faulty Goods should be initially notified by telephone and then confirmed in writing by e-mail or letter marked for the attention of the Customer Services Department within 7 days of the fault becoming apparent.
2) In the rare event that Goods develop a fault the Seller reserves the right to have the Goods repaired or replaced at the Seller’s discretion, and any delivery costs associated with the exchange of faulty goods will be met by the Seller.
3) Any natural characteristic of or natural changes occurring to the natural products making up the Goods are specifically excluded from being defined as a fault.

Refunds;
1) Refunds on Goods cancelled prior to the Delivery will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 30 days of that written notice. All refunds will be made onto the same card used to make the original purchase less ant charges/costs incurred by the Seller.
2) Refunds on Goods already delivered will take place as soon as possible following the collection, return and inspection of such Goods and in any case will not exceed a period of 30 days following that collection/return but shall be dependent upon the Goods being received in exactly the same condition to that which they were at the date of Delivery or as may be agreed if the Seller chooses to exercise at the Sellers absolute discretion.

Cancellations;
1) The Buyer may cancel the Goods at any time within seven working days following delivery of Goods. All other cancellations will only be accepted at the sole discretion of the Seller.
2) There is a collection fee of  £100.00 (or lesser sum as may be agreed) payable to the Seller or their agents to collect the goods, or the Buyer may return the goods (at the Buyers sole cost unused and undamaged, to the Seller at Units 1-4 Castle Trading Estate  Portchester  Hampshire  PO16 9SF.
3) The Goods must be unused, made available for collection and be in the original packaging and in the original condition at a time requested by the Seller (this request not to exceed 14 days from the cancellation date)
4) Following collection or return, should the Goods be found to be damaged (not in their original condition), and the damage is not the result of the Seller’s actions or negligence, the Seller will deduct a reasonable amount from any refund to cover such damage.
5) No refund shall be made until the Goods have been collected/returned and inspection made as to condition.
